Dear Sir/Madam,
I am writing from Italy to submit a FORMAL ANIMAL WELFARE COMPLAINT concerning a social media profile apparently operating in the Jhunjhunu / Nawalgarh area of Rajasthan, India.
The profile repeatedly publishes videos showing horses, camels and other animals being used for entertainment and made to perform.
Of particular concern is the following video, which appears to show a HORSE BEING MADE TO PERFORM IN IMMEDIATE PROXIMITY TO BURNING FIRE:

THIS FOOTAGE REQUIRES INVESTIGATION.
The competent authorities must establish exactly what occurred, identify the persons responsible for the animal and verify the methods used to train, handle and control the horse.
The matter is particularly serious in light of Indian legislation governing performing animals.
The Performing Animals (Registration) Rules, 2001 regulate the use of performing animals and establish conditions intended to prevent unnecessary pain and suffering, including provisions concerning animals being brought close to fire or exposed to burning fire.
This is therefore not merely a question of whether a performance is described as traditional, cultural or entertaining.
THE QUESTION IS WHETHER THESE ANIMALS ARE BEING TREATED IN ACCORDANCE WITH INDIAN LAW AND WHETHER THEIR WELFARE IS BEING EFFECTIVELY PROTECTED.
I formally request verification of:
whether the persons responsible are legally registered to use performing animals;
the identity of the persons responsible for the horses and camels;
where these animals are kept;
where and how they are trained;
what methods and equipment are used to induce, force or control the movements shown in the videos;
whether the horse shown in the above footage was exposed to burning fire or to circumstances capable of causing fear, distress or injury contrary to applicable rules;
whether the animals are subjected to physical coercion, pain, fear, punishment, deprivation of food or water, or any other unnecessary suffering;
the physical and veterinary condition of all animals involved;
whether the other horses, camels and animals repeatedly appearing on the same profile are subjected to similar practices.
The profile contains repeated footage of horses and camels performing movements presented as “dancing”.
This raises a question that cannot simply be ignored:
HOW ARE THESE ANIMALS TRAINED TO PERFORM THESE BEHAVIOURS, AND WHAT HAPPENS TO THEM AWAY FROM THE CAMERA?
An on-site inspection is necessary to establish the actual conditions in which these animals are housed, trained, handled and used.
These videos are being openly published and circulated on social media and are being viewed internationally.
They have generated concern and indignation among people in different parts of the world.
ANIMALS CANNOT BE PLACED IN FRIGHTENING OR POTENTIALLY DANGEROUS SITUATIONS SIMPLY FOR HUMAN ENTERTAINMENT.
Calling something a “show”, “dance”, “tradition” or “entertainment” does not exempt anyone from animal-welfare legislation.
I am not asking the authorities to presume guilt solely on the basis of social media footage.
I am asking the authorities NOT TO IGNORE PUBLICLY AVAILABLE MATERIAL THAT CLEARLY WARRANTS OFFICIAL VERIFICATION.
UPDATE AND STRENGTHEN THE LAW
This case also raises a broader issue.
I call upon the competent authorities and the Government of India to UPDATE AND STRENGTHEN THE LEGISLATION GOVERNING THE USE OF ANIMALS FOR ENTERTAINMENT.
The Performing Animals (Registration) Rules date from 2001.
Animal-welfare legislation must evolve in accordance with current scientific understanding of animal sentience, fear, stress, pain and suffering.
Where existing provisions are insufficient to prevent animals from being subjected to coercive, frightening or dangerous performances, THE LAW MUST BE STRENGTHENED.
Animals should not be forced to perform unnatural behaviours merely to entertain people.
INDIA – THE LAND OF YOGA AND AHIMSA
India is known throughout the world as THE LAND OF YOGA, and for a philosophical and spiritual tradition deeply associated with AHIMSA — NON-VIOLENCE AND RESPECT FOR LIVING BEINGS.
There is a profound contradiction between these principles and images of animals being forced to “dance”, perform unnatural movements or remain close to burning fire for human entertainment.
AHIMSA CANNOT BE ONLY A PRINCIPLE CELEBRATED IN WORDS.
Respect for living beings must also be reflected in the laws that protect them and in their effective enforcement.
UPDATE THE LAW.
STRENGTHEN ANIMAL PROTECTION.
ENFORCE THE RULES ALREADY IN FORCE.
Tradition and entertainment cannot justify avoidable fear, pain or suffering.
India has the opportunity — and the responsibility — to ensure that the protection afforded to animals reflects the principles for which the country is known throughout the world.
FORMAL REQUEST FOR ACTION
I therefore formally request that the competent authorities:
identify the persons responsible for the animals shown in the videos;
establish the exact location where the animals are kept, trained and made to perform;
verify all registrations and authorisations required for the use of performing animals;
carry out an on-site animal-welfare and veterinary inspection;
examine the training, handling and control methods used on the horses and camels;
determine whether the activities shown comply with the Prevention of Cruelty to Animals Act, 1960 and the Performing Animals (Registration) Rules, 2001;
specifically investigate the use of burning fire shown in the video;
examine the treatment and welfare of the other animals appearing on the same social media profile;
take all appropriate enforcement action if violations are established;
consider whether the existing legislation governing performing animals requires further strengthening in order to prevent similar practices.
THE REPEATED AND PUBLIC NATURE OF THESE VIDEOS MAKES OFFICIAL VERIFICATION NECESSARY.
I request written acknowledgement of this complaint and information regarding the authority or officer to whom the matter has been assigned.
I also request, insofar as permitted by law, information concerning the outcome of the investigation, any inspection carried out and any measures taken.
This complaint concerns animals currently being used for public entertainment.
IT SHOULD BE INVESTIGATED WITHOUT UNNECESSARY DELAY.
The protection of the most vulnerable constitutes an immediate public duty, requiring clear, traceable actions consistent with the applicable legal framework.

सक्षम अधिकारियों को यह स्थापित करना चाहिए कि वास्तव में क्या हुआ, पशु के लिए जिम्मेदार व्यक्तियों की पहचान करनी चाहिए तथा घोड़े को प्रशिक्षित, संभालने और नियंत्रित करने के लिए इस्तेमाल किए जाने वाले तरीकों की जाँच करनी चाहिए।
यह मामला भारत में प्रदर्शन करने वाले जानवरों से संबंधित कानून के संदर्भ में विशेष रूप से गंभीर है।
Performing Animals (Registration) Rules, 2001 प्रदर्शन करने वाले जानवरों के उपयोग को नियंत्रित करते हैं और अनावश्यक दर्द तथा पीड़ा को रोकने के उद्देश्य से शर्तें निर्धारित करते हैं, जिनमें जानवरों को आग के पास लाने अथवा जलती हुई आग के संपर्क में रखने से संबंधित प्रावधान भी शामिल हैं।
इसलिए प्रश्न केवल यह नहीं है कि किसी प्रदर्शन को पारंपरिक, सांस्कृतिक या मनोरंजक कहा जाता है या नहीं।
वास्तविक प्रश्न यह है कि क्या इन जानवरों के साथ भारतीय कानून के अनुसार व्यवहार किया जा रहा है और क्या उनके कल्याण की वास्तव में रक्षा की जा रही है।
मैं औपचारिक रूप से निम्नलिखित की जाँच का अनुरोध करती हूँ:
क्या जिम्मेदार व्यक्ति प्रदर्शन करने वाले जानवरों का उपयोग करने के लिए कानूनी रूप से पंजीकृत हैं;
घोड़ों और ऊँटों के लिए जिम्मेदार व्यक्तियों की पहचान;
इन जानवरों को कहाँ रखा जाता है;
उन्हें कहाँ और किस प्रकार प्रशिक्षित किया जाता है;
वीडियो में दिखाई देने वाली गतिविधियाँ करवाने अथवा नियंत्रित करने के लिए किन तरीकों और उपकरणों का उपयोग किया जाता है;
क्या वीडियो में दिखाई देने वाले घोड़े को जलती हुई आग अथवा ऐसी परिस्थितियों के संपर्क में रखा गया जो भय, तनाव या चोट का कारण बन सकती थीं और लागू नियमों के विपरीत थीं;
क्या जानवरों पर शारीरिक बल, दर्द, भय, दंड, भोजन या पानी से वंचित करना अथवा किसी अन्य प्रकार की अनावश्यक पीड़ा का प्रयोग किया जाता है;
संबंधित सभी जानवरों की शारीरिक और पशु-चिकित्सकीय स्थिति;
क्या उसी प्रोफ़ाइल पर बार-बार दिखाई देने वाले अन्य घोड़ों, ऊँटों और जानवरों के साथ भी इसी प्रकार का व्यवहार किया जा रहा है।
इस प्रोफ़ाइल पर घोड़ों और ऊँटों द्वारा “नृत्य” के रूप में प्रस्तुत गतिविधियों के अनेक वीडियो मौजूद हैं।
इससे एक ऐसा प्रश्न उठता है जिसे नज़रअंदाज़ नहीं किया जा सकता:
इन जानवरों को ऐसा व्यवहार करने के लिए किस प्रकार प्रशिक्षित किया जाता है और कैमरे से दूर उनके साथ क्या होता है?
वास्तविक परिस्थितियों को स्थापित करने के लिए स्थल पर निरीक्षण आवश्यक है, ताकि यह जाँचा जा सके कि जानवरों को कहाँ और किन परिस्थितियों में रखा, प्रशिक्षित, संभाला और इस्तेमाल किया जाता है।
ये वीडियो सोशल मीडिया पर खुले तौर पर प्रकाशित और प्रसारित किए जा रहे हैं तथा अंतरराष्ट्रीय स्तर पर देखे जा रहे हैं।
इन दृश्यों ने दुनिया के विभिन्न हिस्सों में चिंता और आक्रोश उत्पन्न किया है।
केवल मानव मनोरंजन के लिए जानवरों को भयावह अथवा संभावित रूप से खतरनाक परिस्थितियों में नहीं रखा जा सकता।
किसी गतिविधि को “शो”, “नृत्य”, “परंपरा” या “मनोरंजन” कहना पशु-कल्याण कानून के पालन से किसी को छूट नहीं देता।
मैं अधिकारियों से केवल सोशल मीडिया वीडियो के आधार पर दोष मान लेने का अनुरोध नहीं कर रही हूँ।
मैं उनसे यह माँग कर रही हूँ कि ऐसी सार्वजनिक सामग्री को नज़रअंदाज़ न किया जाए जो स्पष्ट रूप से आधिकारिक जाँच की आवश्यकता उत्पन्न करती है।
कानून को अद्यतन और मजबूत करें
यह मामला एक व्यापक प्रश्न भी उठाता है।
मैं सक्षम अधिकारियों और भारत सरकार से माँग करती हूँ कि मनोरंजन के लिए जानवरों के उपयोग से संबंधित कानूनों को अद्यतन और अधिक कठोर बनाया जाए।
Performing Animals (Registration) Rules वर्ष 2001 के हैं।
पशु-कल्याण कानूनों को पशुओं की संवेदनशीलता, भय, तनाव, दर्द और पीड़ा के संबंध में वर्तमान वैज्ञानिक समझ के अनुरूप विकसित होना चाहिए।
यदि वर्तमान प्रावधान जानवरों को जबरदस्ती, भय अथवा खतरनाक प्रदर्शनों से पर्याप्त रूप से नहीं बचा सकते, तो कानून को मजबूत किया जाना चाहिए।
केवल लोगों के मनोरंजन के लिए जानवरों को अप्राकृतिक गतिविधियाँ करने के लिए मजबूर नहीं किया जाना चाहिए।
भारत — योग और अहिंसा की भूमि
भारत पूरी दुनिया में योग की भूमि तथा अहिंसा — जीवों के प्रति सम्मान और हिंसा से बचने — की गहरी दार्शनिक और आध्यात्मिक परंपरा के लिए जाना जाता है।
इन सिद्धांतों और मनोरंजन के लिए जानवरों को “नृत्य” करने, अप्राकृतिक गतिविधियाँ करने अथवा जलती हुई आग के पास रहने के लिए मजबूर किए जाने वाले दृश्यों के बीच एक गंभीर विरोधाभास है।
अहिंसा केवल शब्दों में मनाया जाने वाला सिद्धांत नहीं हो सकता।
जीवों के प्रति सम्मान उन कानूनों में भी दिखाई देना चाहिए जो उनकी रक्षा करते हैं और उन कानूनों के वास्तविक प्रवर्तन में भी।
कानून को अद्यतन करें।
पशु संरक्षण को मजबूत करें।
पहले से लागू नियमों को प्रभावी रूप से लागू करें।
परंपरा और मनोरंजन टाले जा सकने वाले भय, दर्द अथवा पीड़ा को उचित नहीं ठहरा सकते।
भारत के पास यह सुनिश्चित करने का अवसर और जिम्मेदारी है कि जानवरों को मिलने वाली वास्तविक सुरक्षा उन सिद्धांतों को प्रतिबिंबित करे जिनके लिए यह देश दुनिया भर में जाना जाता है।
कार्रवाई की औपचारिक माँग
अतः मैं सक्षम अधिकारियों से औपचारिक रूप से माँग करती हूँ कि वे:
वीडियो में दिखाई देने वाले जानवरों के लिए जिम्मेदार व्यक्तियों की पहचान करें;
उस सटीक स्थान की पहचान करें जहाँ जानवरों को रखा, प्रशिक्षित और प्रदर्शन के लिए इस्तेमाल किया जाता है;
प्रदर्शन करने वाले जानवरों के उपयोग के लिए आवश्यक सभी पंजीकरण और अनुमतियों की जाँच करें;
स्थल पर पशु-कल्याण और पशु-चिकित्सकीय निरीक्षण करें;
घोड़ों और ऊँटों पर इस्तेमाल किए जाने वाले प्रशिक्षण, संभालने और नियंत्रण के तरीकों की जाँच करें;
यह निर्धारित करें कि दिखाई गई गतिविधियाँ Prevention of Cruelty to Animals Act, 1960 और Performing Animals (Registration) Rules, 2001 के अनुरूप हैं या नहीं;
वीडियो में दिखाई गई जलती हुई आग के उपयोग की विशेष रूप से जाँच करें;
उसी सोशल मीडिया प्रोफ़ाइल पर दिखाई देने वाले अन्य जानवरों के साथ किए जा रहे व्यवहार और उनके कल्याण की भी जाँच करें;
यदि उल्लंघन स्थापित होते हैं तो कानून के अनुसार सभी उचित कार्रवाई करें;
यह भी विचार करें कि भविष्य में ऐसी गतिविधियों को रोकने के लिए प्रदर्शन करने वाले जानवरों से संबंधित मौजूदा कानूनों को और मजबूत करने की आवश्यकता है या नहीं।
इन वीडियो का बार-बार और सार्वजनिक रूप से प्रकाशित होना आधिकारिक जाँच को आवश्यक बनाता है।
मैं इस शिकायत की लिखित प्राप्ति-पुष्टि तथा यह जानकारी माँगती हूँ कि मामला किस सक्षम अधिकारी या विभाग को सौंपा गया है।
कानून द्वारा अनुमत सीमा तक मैं जाँच के परिणाम, किए गए निरीक्षण तथा उठाए गए कदमों के संबंध में भी जानकारी दिए जाने का अनुरोध करती हूँ।
यह शिकायत वर्तमान में सार्वजनिक मनोरंजन के लिए इस्तेमाल किए जा रहे जानवरों के कल्याण और सुरक्षा से संबंधित है।
इसकी जाँच अनावश्यक देरी के बिना की जानी चाहिए।
सबसे कमजोर और असहाय प्राणियों की रक्षा करना एक तात्कालिक सार्वजनिक कर्तव्य है, जिसके लिए लागू कानूनी ढाँचे के अनुरूप स्पष्ट, ठोस और जवाबदेह कार्रवाई आवश्यक है।
